Terms and Conditions 

 

This website is operated by Cutback Carter the terms "we", "us" and "our" refer at all times to Cutback Carter. By visiting the site, continuing to use this site and/or placing an order, you are agreeing to the terms and conditions set out below. We advise that you read through the terms and conditions before using our website. We reserve the right to update, change or replace these terms and conditions from time to time without notifying you. Your continued use of our site following any changes made to these terms and conditions constitutes acceptance of any such changes.

Terms of Sale

 

When placing an order you are subject to the following terms and conditions. All orders are subject to availability and confirmation of the purchase price. 

 

On placing an order, you will receive an acknowledgement email confirming receipt of your order which will be sent to the email address provided at check out. This email is strictly an acknowledgement of your offer to purchase a product and will not constitute acceptance of your order. A contract will only be formed following a confirmation email from us that your goods have been dispatched. 

 

We reserve the right to refuse any order for a number of reasons (including, but not limited to where the product ordered is not in stock or is no longer available, there is an inability to obtain authorisation of payment and/or our site contains an error relating to the price). If we refuse an order we will inform you of this and will not process your order. In the event that payment for the product has already been taken, we will refund the full amount  as soon as reasonably practicable. 

 

Condition of the items

 

You accept that the products sold on our site are vintage and preloved items. The products have therefore been previously worn unless expressly stated otherwise. We do not acquire our products from the original supplier or manufacturer. We therefore cannot guarantee the origin of all items, nor how the products have been handled or treated before coming into our possession and we cannot be held accountable for the same. 

 

We use our reasonable endeavours to describe the wear and condition of each item on our website and by placing an order, you are acknowledging the wear and condition of the item as shown and described on our website. Please note that although we have made every effort to display the colours of the product accurately, we cannot guarantee the quality of the image on your computer and the images of our products on our website are for illustrative purposes only.

Returns

 

If you are unhappy with your products, we offer returns on any item (excluding hats and swimwear) for a full refund if you notify us within 14 days of receiving them. If you wish to return an item please email us at cutbackcarter@gmail.com within 14 days of receipt. Please include the order number in the email. We can then assist with the return of your product. Once you have notified us, you will then have an additional 14 days to return the item.

 

In order to qualify for a full refund the items must meet the following criteria: 

All original tags must be attached; and

All items must be returned in the same condition as they were received; and

All items have not been worn and must not be damaged; and

All items are free of any odours. 

 

We aim to process all returns within 14 working days of your goods being received by us (excluding weekends and bank holidays). 

 

For avoidance of doubt, we are not responsible for returned products until they are received by us. You are strongly advised to use recorded or insured or signed for mail services when returning items to us and to keep proof of postage as we will not accept liability for any orders that are lost by mail providers. 

 

Your refund will be credited back to the original method of payment. 

 

All refunds (other than where expressly specficied otherwise in these terms and conditions) are for the price paid for the product only and exclude any postage costs (which includes the cost of original delivery and return postage costs).

 

If you beleive that your items are faulty or not as described then please email  us at cutbackcarter@gmail.com with your order number and a description of the damage, defect or misdescription. We will endeavour to resolve the situation as soon as possible and any items deemed faulty or misdescribed will be eligable for a full refund (including the cost of postage). Please note that the maximum amount we can refund for postage costs if the item is deemed faulty or misdescribed is the standard Royal Mail recorded delivery cost. We cannot refund the costs for items returned to us via courier, express delivery, delivery at a certain time or next day delivery. 

 

For avoidance of doubt we do not offer returns or refunds on any hats or swimwear for hygiene purposes.

 

Cancellations or amendments 

 

Once your order is placed we cannot accept any cancellation of or amendments to any order. You can however benefit from the refunds policy detailed above if you are not happy with the items once received. Whilst our policy is that we cannot accept any cancellation or amendment of orders once received, if you wish to cancel or amend any order after it has been placed then please email us at cutbackcarter@gmail.com and we will (in our sole discretion) endeavour to assist with your query before dispatch if we are able. 

 

Pricing and Availability 

 

We must receive payment in full before any items are dispatched. 

 

Whilst we use reasonable endeavours to ensure that all details on our site are accurate, errors may occur. In the event that we discover an error in the price or description of any item we will notify you as soon as reasonably practicable and give you the option of reconfirming the order or cancelling it. If we do not hear from you within 14 days of notifying you by email of any errors, we will treat the order as cancelled. 

 

The price of the product does not include delivery charges which will be as quoted on our site from time to time. 

 

Intellectual Property, Software and Content 

 

The copyright and other ownership rights in our website and its content (which includes but is not limited to photographs, design, text, logos, trade names, graphics and any other material) are owned by Cutback Carter and you must not use any content from our website for business related or commercial purposes. The storage, printing and display of our content for personal use only is permitted. 

 

Disclaimer 

 

Any third party trademarks and images of third party products on our website are in no way linked or affiliated with Cutback Carter. Where a trademark or brand name is used it is used solely to describe or identify the products and is not an assertion that any such products are endorsed by or connected to Cutback Carter.

 

Disruptions or delays outside of our control 

 

We will not be responsible for any delay or failure to perform any of our obligations under these terms and conditions if such delay or failure is caused by an event that is outside our control (which includes but is not limited to strikes, civil commotion, riot, war, fire, explosion, storm, flood, earthquake or any natural disaster). If any such event occurs and affects the performance of our obligations under our contract with you we will notify you as soon as reasonably practicable and our obligations under any agreement will be extended for the duration of the event that is outside our control. 

 

Our Liability 

 

We are not responsible for any loss or damage suffered by you as a result of our breach of these terms and conditions where such losses are unexpected or unforeseeable, caused by an event outside our control, something that was avoidable if you had taken reasonable action or a business loss. 

 

Other terms 

 

We reserve the right to transfer our contract with you so that a different organisation is responsible for fulfilling your order. We will notify you if this happens and any transfer will not affect your rights under the contract. 

 

Each of the paragraphs under these terms and conditions operates separately and in the event that a court or other authority determines that some of these terms are unenforceable or unlawful the rest will still apply. 

 

If we delay enforcing any of our rights or your obligations under these terms and conditions, this will not constitute a wavier of any such rights or remedies we have. 

 

These terms and conditions are to be construed in accordance with the law of England and are subject to the jurisdiction of the English courts. 

 

These terms and conditions constitute the entire agreement of the parties.
